IMPORTANT NOTICE ABOUT RELEASE OF LIABILITY: SECTION 13 CONTAINS AN EXPRESS ASSUMPTION OF RISK AND RELEASE OF CLAIMS ARISING FROM ORDINARY NEGLIGENCE, INCLUDING CERTAIN PERSONAL-INJURY CLAIMS. PLEASE READ IT CAREFULLY BEFORE ENROLLING A CHILD. A PARENT OR LEGAL GUARDIAN MUST ACCEPT THESE TERMS FOR EACH PARTICIPATING MINOR.
1. Acceptance; parties; scope
These Terms govern the purchase of and participation in A Musical Home LLC's caregiver-accompanied music classes, class series, trials, workshops, and other educational programs (collectively, "Programs"). Private events and birthday parties may also require a separate event agreement, which will control event-specific terms if inconsistent with these Terms.
The contracting service provider is A Musical Home LLC, not its member or instructor individually. By completing registration or expressly accepting these Terms, the registering adult ("Parent") represents that they are the parent or legal guardian of each child registered ("Participant"), have authority to enter this agreement, and agree on their own behalf and on behalf of the Participant to the extent permitted by law. An adult who is not a parent or legal guardian may accompany a child but may not accept the liability release on the child's behalf unless legally authorized to do so.
These Terms apply to the specific Programs identified at registration. New types of activities or materially different events may require additional consent. The Privacy Policy and any program-specific written terms are incorporated only to the extent expressly identified during registration; promotional photography consent is separate and optional.
2. Description of Programs
A Musical Home offers early-childhood music education with live musical instruments, singing, movement, dancing, age-appropriate instrumental exploration, and interactive activities that may use percussion, puppets, bubbles, parachutes, and other educational materials. The specific ages, locations, times, dates, duration, tuition, and included sessions are described on the applicable registration page or written booking confirmation.
We may make reasonable changes to instruments, instructors, songs, activities, and class format for educational, operational, and safety reasons. We will communicate material schedule or venue changes to affected families.
3. Adult supervision and participation rules
Programs are caregiver-accompanied activities, not drop-off childcare. A parent or designated responsible adult must remain physically present, attentive, and directly responsible for the Participant throughout the Program. The adult must assist as needed, keep the child within designated activity areas, and follow reasonable instructor and venue safety directions. Instructors lead music activities but do not assume custodial responsibility for a child.
Children may use instruments or activity materials only as directed. Adults must prevent children from putting small objects or unsuitable materials in their mouths, running with instruments, accessing restricted equipment, or engaging in activities beyond their abilities. An instructor may pause or adapt an activity or ask a family to step out temporarily if reasonably necessary for safety.
4. Enrollment, eligibility, and minimum registration
Spaces are limited, and enrollment is subject to available capacity and the age or participation requirements stated for each Program. Registration is confirmed only when required payment and enrollment/consent steps have been completed and accepted. A Musical Home may set a minimum number of participants before opening a class; minimums and maximums, if any, are disclosed in the applicable class offer or subsequent registration communications.
If a paid Program does not open because minimum enrollment is not reached, customers will be offered a refund for services not delivered or may voluntarily choose an available alternative.
5. Fees and payment
Tuition, trials, class packs, deposits, discounts, and any included services are as stated in the applicable registration or written booking confirmation. Unless otherwise specified, payment is due when registering. Promotional or referral benefits apply only under the terms communicated with the offer and cannot be exchanged for cash except where required by law.
If a product page, invoice, and checkout display inconsistent prices or dates, contact us before paying to obtain written clarification. We will not retroactively charge a higher price without the customer's authorization.
6. Family cancellations, missed classes, and refunds
Because spaces and instructor time are reserved in advance, registration payments for confirmed multi-class sessions are generally nonrefundable if a family withdraws or misses a scheduled class, unless the registration offer provides otherwise or applicable law requires a refund. A missed class does not by itself entitle the family to a partial refund.
Trials, credits, gift certificates, and private-event deposits may have additional written terms, subject to applicable law. No provision of these Terms overrides mandatory refund rights.
7. Makeup classes, transfers, and expiration
Where the applicable registration offer includes unlimited makeups, families may request to reschedule eligible missed classes within that purchased session, subject to space, suitable age grouping, advance approval, and the published expiration date. "Unlimited" does not add visits beyond the number purchased, guarantee space in a preferred class, or extend the session expiration date.
Any substitution, gifting, or transfer of a class spot to a different child requires A Musical Home's prior approval and completion of registration and parent/legal-guardian acceptance of these Terms for that child before participation. An original family's acceptance does not cover another family's child.
8. Cancellations and changes by A Musical Home
We may reschedule, relocate, move indoors, or cancel a Program because of instructor illness, inadequate enrollment, facility problems, extreme heat, severe weather, government restrictions, public-health concerns, or other circumstances making the activity impracticable or unsafe.
For a paid class that we do not deliver, we will offer an appropriate replacement session or alternative by mutual agreement. If we cannot provide a reasonable replacement accepted by the family, we will provide an appropriate refund for the undelivered portion, as required by applicable law. For an entire paid session canceled before it starts, customers may choose a refund rather than a substitute program. We will give notice as soon as reasonably practicable using the contact information provided at registration.
9. Illness, health, and accessibility
Participants and accompanying adults should not attend while experiencing a potentially contagious illness, including fever, vomiting, or diarrhea, or when advised to stay home by a healthcare professional. We may reasonably ask an ill attendee to leave to protect the group. Families are responsible for assessing their child's ability to participate and for advising us in advance of accommodations or immediate safety considerations relevant to class activities. We will consider reasonable accommodation requests consistent with applicable law.
A Musical Home does not provide medical diagnosis, treatment, or childcare. In an apparent emergency, the instructor may call 911 and attempt to contact the responsible adult or emergency contact. Nothing in these Terms imposes a duty to provide medical care beyond duties established by law.
10. Locations and private-home hosts
Programs may be held at homes, schools, educational facilities, studios, and community venues. Participants must follow applicable venue rules. Property owners and hosts remain responsible for legal duties relating to premises under their control, and A Musical Home remains responsible for its own legal duties. We may refuse to start or continue an activity where conditions present unreasonable safety concerns.
A person hosting a group at a private home may be asked to sign a separate Host Location Agreement covering access, suitable space, venue rules, and responsibilities. This document does not independently transfer a host's obligations to participating families.
11. Private parties and special events
Birthday parties, school programs, and other private bookings require written confirmation of services, price, time, location, cancellation terms, and any agreed special requirements. A separate Private Event Services Agreement may be required. An event host's agreement does not automatically constitute a waiver signed by the parents or legal guardians of other children attending. Where participant releases are required, arrangements must be made before children participate.
12. Acknowledgment of activity risks
A Musical Home Programs involve movement and interactive use of instruments and materials. Foreseeable risks include slips, trips, falls, collisions with people or furniture, pinched fingers, contact with instruments or stands, breakage, noise exposure, allergic reactions, and choking or ingestion hazards associated with small objects, bubbles, balloons, or other materials. These risks may cause serious injury in rare circumstances. Adult supervision, safety directions, and reasonable precautions reduce but do not eliminate risk. The Parent understands the activities involved and voluntarily chooses to enroll the Participant.
13. EXPRESS ASSUMPTION OF RISK AND RELEASE OF LIABILITY FOR ORDINARY NEGLIGENCE
PLEASE READ CAREFULLY. THIS SECTION AFFECTS LEGAL RIGHTS.
13.1 Released parties. For purposes of this Section, the "Released Parties" are A Musical Home LLC and its current and former members, managers, officers (if any), employees, instructors, and authorized agents, solely with respect to activities performed for or on behalf of A Musical Home LLC in connection with the registered Program.
13.2 Express release. TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, THE PARENT, INDIVIDUALLY AND ON BEHALF OF THE PARTICIPANT TO THE EXTENT THE PARENT IS LEGALLY AUTHORIZED TO DO SO, KNOWINGLY AND VOLUNTARILY RELEASES THE RELEASED PARTIES FROM CLAIMS FOR BODILY INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE ORDINARY NEGLIGENCE OF A RELEASED PARTY IN THE PLANNING, ORGANIZATION, INSTRUCTION, SUPERVISION, SETUP, OR CONDUCT OF THE REGISTERED PROGRAM, INCLUDING ORDINARY NEGLIGENCE THAT CAUSES OR CONTRIBUTES TO AN ACCIDENT.
13.3 Assumption of risks. The Parent understands and voluntarily accepts the inherent and ordinary risks of participation described in Section 12, including the possibility that the Participant may be injured while handling instruments or materials, moving around a class space, or interacting with other participants. This acknowledgment does not replace the express release in Section 13.2.
13.4 Limits. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS OR INTENTIONAL MISCONDUCT, VIOLATIONS OF LAW, OR OTHER LIABILITY THAT CANNOT BE RELEASED AS A MATTER OF APPLICABLE LAW. It does not purport to waive the rights of a nonconsenting third party or require indemnification for a Released Party's own negligence.
13.5 Guardian authority and understanding. By affirmatively accepting this Section, the Parent represents that they are the Participant's parent or legal guardian, have read and understand that Section 13 seeks to restrict legal claims for injuries caused by ordinary negligence, and voluntarily accepts it as part of the conditions of participation, to the extent enforceable under California law.
13.6 Separate affirmative acknowledgment. The Parent must separately and affirmatively acknowledge this Section 13 during enrollment, in addition to accepting the General Terms & Conditions. This acknowledgment applies to each Participant and the registered Program identified in the enrollment record.
14. General limitations and legal rights
To the extent permitted by law, A Musical Home is not responsible for indirect or consequential economic losses arising from a service dispute. Nothing in this provision excludes liability that California law does not permit us to exclude, diminishes statutory consumer rights, or enlarges the release in Section 13. The Company and individuals may still be responsible for their own conduct when liability cannot lawfully be waived.
15. Photography, media, and privacy
Permission to use a child's identifiable photo, video, name, or likeness for A Musical Home's marketing is not granted by acceptance of these Terms. Any promotional use requires separate, voluntary parent/legal-guardian consent. Families should respect other participants' privacy when photographing or recording classes. Any separately provided Privacy Policy describes our handling of personal information and does not expand the release in Section 13.
16. Content and intellectual property
The Company's original website text, original teaching materials, logos, and original photos or videos it owns are protected by applicable law. Enrolling in a Program does not transfer intellectual-property rights or permit commercial copying or redistribution of proprietary materials without permission. Third-party music and other content remain the property of their respective rights holders.
17. Disputes and governing law
These Terms are governed by California law, without excluding mandatory rights that apply to consumers. Customers are encouraged to contact us at amusicalhome@gmail.com so that we can attempt to resolve concerns informally. If unresolved, disputes may be brought before a court with lawful jurisdiction. These Terms do not impose mandatory arbitration or a class-action waiver.
18. Changes, severability, and contact
We may publish updated Terms prospectively. The version affirmatively accepted at registration generally governs that purchase unless the parties validly agree otherwise or law requires a change. If a provision is unenforceable, the rest remains effective to the extent legally possible; however, severability does not make an otherwise unlawful release enforceable.
